5일, 세월호 유족을 지지하는 해외 학자들이 '세월호 시행령 정부 안의 폐지 및 특별조사위원회 안 수용 요구 성명서'를 발표하고 서명운동에 들어갔다.
이번 성명서는 지난해 5월과 '세월호 참사 진상 규명을 위한 특별법 제정을 요구하는 해외학자 성명서'를 발표했던 남윤주 (버팔로 뉴욕주립대), 김기선미 (뉴저지 라마포대),남태현 (솔즈베리대), 서재정 (일본 국제 기독교 대학), 유종성 (호주국립대) 교수 등 미주에서 활동하는 8명의 교수들이 주도했다.
해외 학자들은 세월호 참사 성명 발표외에도 지난 2월 국제학 학회에서 세월호 참사를 한국의 민주화, 국가론, 신자유주의 정책, 부패 등 각기 다른 측면에서 다각적으로 분석한 바 있다. (관련 기사 : 해외학자들, 세월호 참사와 한국 정치의 역학 관계를 풀다)
이들은 성명을 통해 "대한민국에서 세월호와 같은 비극이 다시 벌어지지 않도록 하기 위해서는 세월호 비극의 원인이 객관적으로 철저히 밝혀져야 한다"며 "정부의 시행령(안)은 특별조사위의 활동범위를 제한하여 모법인 세월호 특별법에 위배되며, 잠재적 조사대상인 공무원들이 특별조사위의 활동을 주도할 수 있도록 하여 특별조사위의 독립성을 침해하는 심각한 문제를 갖고 있다"고 밝혔다.
또 이들은 "박근혜 정부가 현 정부 시행령(안)을 즉각 폐기하고, 세월호 특별조사위원회가 제출한 시행령(안)을 정부 안으로 조속히 확정해 공포할 것을 요청"하며, 미국 시간 5월 5일부터 이를 위한 "해외 학자 서명운동에 돌입할 것을 선언한다"고 덧붙였다.

[세월호 시행령 정부안의 폐지 및 특별조사위원회안 수용을 요구하는 해외학자 성명서]
세월호 참사의 철저한 진상 규명은 안전사회를 위한 구조적 개혁의 첫 걸음입니다. 세월호 특별법의 온전한 시행은 그 시작에 불과합니다. 이 중요한 첫 걸음을 막으려는 위헌적 위법적 정부 시행령(안)은 즉시 폐기되어야 하며, 세월호 특별조사위원회가 제출한 시행령(안)을 정부 시행령으로 조속히 확정해 공포해야 합니다.
세월호 참사로304명이 꽃다운 목숨을 잃거나 실종된지 1년이 넘었습니다. 그러나 세월호 참사의 원인에 대한 규명은 이루어지지 않고 있고 책임자에 대한 처벌도 제대로 이루어지지 않았습니다. 유족들의 헌신적인 투쟁과 양보에 힘입어 세월호 특별법이 통과되었으나 특별조사위원회는 제대로 된 조사를 시작하지도 못하고 있습니다. 진상 규명에 앞장서야 할 정부가 오히려 객관적이고 철저한 조사를 원천적으로 막는 시행령을 만들어 진상조사를 방해하려 하고 있기 때문입니다.
또한 세월호 유족들의 요구는 재발 방지를 위한 철저한 진상 조사와 실종자 수습에 있음에도 불구하고 정부와 일부 언론은 유족들이 자신의 이익에 혈안이 되어 무리한 요구를 하고 있는 듯 왜곡하며 유족들을 모욕하고 있습니다. 게다가 정부는 세월호 유족들의 진상규명을 위한 정당한 요구를 차벽과 물대포, 캡사이신을 동원한 폭력으로 억누르고 있습니다. 그들은 진실을 향한 행진, 안전사회를 위한 발걸음을 침몰시키기 위해 앰네스티 인터내셔날이 "끔찍한 수준이었다"고 논평할 정도로 유족들과 시위에 참여한 시민들에게 가혹한 폭력을 행사했습니다.
수백명의 고귀한 생명을 잃은 세월호 비극의 원인과 진실은 객관적으로 철저히 밝혀져야 합니다. 대한민국에서 이와 같은 비극이 다시 벌어져서는 안되기 때문입니다. 모두가 안전한 인간다운 삶을 누릴 수 있어야 하기 때문입니다. 이를 위한 행진이 첫 걸음을 떼기도 전에 침몰할 수도 있다는 위기감에, 해외에 있는 교수와 학자들은 박근혜 정부에 다음과 같이 요구합니다.
1. 정부는 현 시행령(안)을 즉각 폐기해야 합니다.
a. 정부 시행령(안)은 특별조사위의 활동범위를 제한하여 모법인 세월호 특별법에 위반하는, 위법적 시행령(안)이기 때문입니다.
b. 정부 시행령(안)은 잠재적 조사대상인 공무원들이 특별조사위의 활동을 주도할 수 있도록 하여 특별조사위의 독립성을 침해하는 위헌적 시행령(안)이기 때문입니다.
2. 그 대신 세월호 특별조사위원회가 제출한 시행령(안)을 정부 시행령으로 조속히 확정해 공포해야 합니다.
a. 이 시행령안이야말로 세월호 특별 조사위의 독립성을 보장하고 진상 규명을 위한 활동을 가능하게 하기 때문입니다.
3. 아직도 가족의 품에 돌아오지 못한 9명의 실종자를 찾고 진상규명을 위해 세월호를 조속히 그리고 원형이 손상되지 않도록 인양해야 합니다.
4. 세월호 유족들에 대한 탄압을 즉각 중단하고 집회와 시위의 권리를 보장해야 합니다.

Overseasscholars demand that the Korean government abandon its Draft Enforcement Decree(DED) of the Sewol Special Act and adopt the Special Investigation Committee's
Thorough investigation of the Sewol Ferry tragedy is thefirst step towards fundamental and structural changes for safe society. Acomplete implementation of the Sewol Special Act would make that step possible.The government's DED, designed to thwart the implementation of the Act, must beimmediately abandoned. The Korean government must instead adopt the enforcementdecree proposed by the Sewol Special Investigation Committee.
More than one year has passed since 304 precious lives werelost in the tragedy. Still, its causes remain unearthed, and its perpetratorsunpunished. The Sewol Special Act, passed only thanks to several months ofdevotion and struggle by the victims' families, remains to be implemented, andthe Special Investigation Committee has yet to begin its investigation. ThePark administration, that should lead the efforts to find the truths, isinstead stymieing them by crafting the DED that is designed to hamper anobjective and thorough investigation.
Furthermore, the administration has resorted to violence tosuppress the families' just demand for truths by a peaceful march. It hascreated walls with police buses, fired water cannons, and shot tear gas tosuppress the demand for the implementation of the Sewol Special Act. It hasused naked force that the Amnesty International characterized as "an insult tothe victims and a violation of the rights to freedom of expression and peacefulassembly" in order to stop the march towards truths and sink the efforts forsafe society. Adding insult to the injury, the administration, hand in handwith some media, is spreading the groundless rumor that victims' families aremaking unreasonable demands in order to gain profits. It has done all ofthis, when in fact the only thing thefamilies ask for isa thorough investigation and the return ofthe stillmissing nine victims.
The truth about Sewol Ferry tragedy must be revealed throughthorough investigation lest similar tragedies should recur in the future.Every citizen must be able to enjoy the right to live in safe environments. We,oversea scholars, are deeply concerned that our march towards safer societymight sink even before we take the first step. Therefore, we demand thefollowings:
1. The Park administration mustimmediately abandon its Draft Enforcement Decree of the Sewol Special Act because
a. Its DED violates the SewolSpecial Act, the higher law it is designed to implement, by restricting thescope of the Special Investigative Committee's investigative power; and
b. Its draft decree violatesConstitutional principles that guarantee the independence and autonomy of theSpecial Committee created by the National Assembly, by delegating thecommittee's investigative power to administration officials who are potentialtargets of the investigation.
2. The administration mustimmediately adopt the decree proposed by the Special Investigative Committeebecause
a. The committee's draftguarantees the special investigative committee's independence that will ensureits thorough investigative activities.
3. The administration mustexpedite the recovery of the sunken vessel without damage so that the ninemissing bodies may be retrieved and the causes of the tragedy revealed.
4. The administration mustimmediately stop its use of violence against the Sewol victims' families, andguarantee the rights to assembly and demonstration.
